保障养老金改革 澳大利亚议会最近收到一份法案,包含大量针对保障养老金super guarantee基本政策的修订。如果法案通过,预期将于2018年7月1日生效。 第一项变革主要是要改善雇员未获得雇主应付保障养老金的状况,预计将保障养老金纳入 「国家聘用标准」(National Employment Standards)中一并规范。 这项变革将使公平工作调查局得以依法定步骤,协助雇员领回未付养老金,并且提供雇员一个比税务局积极的合法管道,取回养老金。 变革要点包括: 支付养老金后,雇主须通知雇员(预计会将保障养老金直接注记在薪资条上)。 确保雇员的薪金牺牲供款(salary sacrifice)不会被当作雇主供款 (即个人供款将不能降低雇主应付保障养老金) 取消原本当雇员月工资低于$450时,雇主将不须为其支付保障养老金的豁免条例。 针对养老金基金管理公司,对于那些本应该供入却未实质收到的养老金数额,养老金管理公司必须通知该成员应收但未收到的款项数目。 此外,税务局将核实雇主是否遵守保障养老金的相关条例,并给未遵守之雇主提供改善建议。

公司税新政将重新调整

公司税新政将重新调整 本月最大新闻是政府对公司税公告:新的公司税政策将被重新调整。 即便此前有许多不确定的因素,这项公告仍然符合多数人对于最近调降的公司税率的预期。政府也进一步确认这项变革,针对被动收入占总体营收80%以上的公司,将不再适用新的较低公司税率。 尽管目前还须等待税务局的进一步说明(最快11月),澳洲政府已经先一步介入了本次财政变革,限制只有从积极交易活动中获利20%以上的公司才可适用下调的公司税率。 财政局新发布的草案阐明新规将如何实施,但需要注意的是,在新法正式推出前,该项草案的内容可能仍会调整。 该项草案规定了只有达到以下标准的公司才可以按照低税率(27.5%)纳税: 在相关财政年度中有生意运营 该公司整体年收入低于营收门槛(2017年营收门槛为$1,000万) 被动性资产收入低于80% 当中被动性收入包含以下项目: 从另一家公司获取的分红(除非其持有配股公司,10%以上的股权) 利息收入 租金收入 资产增值 在合伙企业或信托中流动,并会产生被动性收入的资本 证券增值 这些变革确定了只拥有租赁性资产的公司无法适用较低税率。但对于从相关信托机构获得分红的公司,如果旗下有自营企业,且从积极生意运营活动中的获利占总营收20%以上(无论是否与信托机构直接相关),仍可适用此税率。在这种情况下,我们还是需要判断该公司的自营企业是否符合一般标准。 某些情况下,客户需要修正2017的报税单,以反映不同的税率。这部分的处理方式尚待税务局进一步说明。 分红抵免(即可用于抵扣该企业已经支付了的企业收入税)比率也会调整。如果下述的状况成立,您就必须以当年度的税率,来决定该公司某一财务年度的分红抵免税率: 该公司在当年度的总营收与过去一年相同 该公司在当年度的可纳税收入与过去一年相同 该公司在当年度的被动收入与过去一年相同 对于有些已经分发2017年利息抵免的公司,税额部分将遭到强制调整,这些调整对于持股人而言,可能产生更多变化。
