保障养老金改革

澳大利亚议会最近收到一份法案,包含大量针对保障养老金super guarantee基本政策的修订。如果法案通过,预期将于2018年7月1日生效。

第一项变革主要是要改善雇员未获得雇主应付保障养老金的状况,预计将保障养老金纳入 「国家聘用标准」(National Employment Standards)中一并规范。

这项变革将使公平工作调查局得以依法定步骤,协助雇员领回未付养老金,并且提供雇员一个比税务局积极的合法管道,取回养老金。

变革要点包括:

  • 支付养老金后,雇主须通知雇员(预计会将保障养老金直接注记在薪资条上)。
  • 确保雇员的薪金牺牲供款(salary sacrifice)不会被当作雇主供款 (即个人供款将不能降低雇主应付保障养老金)
  • 取消原本当雇员月工资低于$450时,雇主将不须为其支付保障养老金的豁免条例。
  • 针对养老金基金管理公司,对于那些本应该供入却未实质收到的养老金数额,养老金管理公司必须通知该成员应收但未收到的款项数目。

此外,税务局将核实雇主是否遵守保障养老金的相关条例,并给未遵守之雇主提供改善建议。
